LEGAL BASIS OF THE DRAW

DRAW FOR 1 NIGHT AT THE TREE HOUSE

1. ORGANIZING COMPANIES

NOMADFESTIVAL MEDITERRANI SLU with address at Ronda Maiols 1, premises 110-112 08192, Sant Quirze de Vallès, Barcelona with CIF number B66745134, and Xalet de Prades SL with address at C / Riu Brugent 16 CP. 43364 of Prades, Tarragona. With CIF number B43832799, they organize a raffle called "VINDRE AL NOMAD TE PREMI" (hereafter "Raffle"), nationwide, to be developed via the internet, exclusively for users resident in Spain (Peninsula and Balearic Islands) and with the purpose of promoting and publicizing the opinion of the participants.

2. SCOPE AND DURATION
2.1. The activity will take place throughout Spain. The draw will be held at the edition of Nomad Festival Xperience de Riudecols, starting on the 6th, and ending, with its resolution, on the 22nd of August 2021.

2.2. At the time of delivery of the accommodation, a rental contract will be formalized between the client and the company XALET DE PRADES SL governed exclusively by Spanish law, by the general conditions set out here and by the special conditions agreed between the parties. The customer will organize his own trip.

3. PURPOSE
The purpose of the draw is to reward a Nomad Festival attendee who has agreed to belong to the database of the companies organizing the event, providing their name and email.

4. REQUIREMENTS TO PARTICIPATE

4.1. The following can participate in the draw:

• Only participants who have purchased a ticket for Nomad Festival Xperience for any of the days from 7 to 22 August 2021 will be able to take part in the draw.

• In the Draw2, the participant will have to upload a story on their Instagram profile tagging @ nomadfestival.es and @xaletdeprades respectively.

4.2. They will not be able to participate:

• Employees of NOMADFESTIVAL MEDITERRANI SLU

• Employees of XALET DE PRADES SL

• Those under 18 who stay without adults must bring an express written authorization.

• Companies that maintain an agency or service provision commercial relationship with NOMADFESTIVAL MEDITERRANI SLU.

If any of the people excluded from participation is a winner, they will lose their right to obtain the prize won and the prize will be awarded to the next person who meets the valid participation conditions from among the designated substitutes.

​

5. PRIZE AND GENERAL CONDITIONS

The prize will consist of:

• 1 night's accommodation at CASA DE L'ARBRE for each of the draws. Accommodation equipped with beds, heating, jacuzzi, table and chairs.

• Breakfast included.

• In no case will the prize be exchanged for another gift / service / or for money. Nor can the dates be changed once chosen.

• Check-in must be before 8pm and no later than 3pm and departure time is 11am.

• In any case, the winner / s must follow the rules of Xalet de Prades like any other customer. I will seeLegal conditions

• The award will be valid during the year 2021-2022. The dates will be chosen by the client and will be in low season. Bridges and public holidays are considered high season.

       GET DOWN: Sunday to Thursday, as long as it does not coincide with the months of T. ALTA i      _cc784de-3905-5c781905-5cde-3194-bb3b-136bad5cf58d_ bb3b-136bad5cf58d_  T.AVERAGE.
       half: June, September, weekends, bridges, the month of September except the heads -136bad5cf58d_       of T. ALTA week.
        HIGH: July, August, Christmas, Easter

6. MECHANICS OF THE DRAW AND SELECTION OF THE WINNER

6.1. To participate in the draw, you must complete the database membership form correctly, legibly and in full, as well as accept the Privacy Policy.

One winner and five alternates will be chosen by random drawing. The raffle will take place on August 22, 2021. The name of the raffle winner will be communicated via email personally and will be made public on the same day on social networks (Facebook and Instagram) of Nomad Festival and Xalet de Prades .

If it is not possible to contact the winner within 24 hours of the first contact attempt, or if the winner renounces the prize, a new winner will be selected, with the previous winner losing their right to claim the prize .

7. RESERVATIONS AND LIMITATIONS

NOMADFESTIVAL MEDITERRANI SLU and XALET DE PRADES SL want the draw between the different participants to be made with equal opportunities and with strict respect for the rules of good faith. For this reason, any abusive or fraudulent use of these bases will result in the consequent disqualification of the participant in the draw.
The finding of any of these circumstances during the draw will mean the automatic disqualification of the draw, as well as the loss of the prize if it had been awarded. NOMADFESTIVAL MEDITERRANI SLU and XALET DE PRADES SL are exempt from any responsibility in the event of any error in the data provided by the recipients themselves that prevents their identification.

NOMADFESTIVAL MEDITERRANI SLU and XALET DE PRADES SL reserve the right to take legal action against those who carry out any type of act likely to be considered manipulation or falsification of the promotion.

​

NOMADFESTIVAL MEDITERRANI SLU and XALET DE PRADES SL reserve the right to make changes that result in the good end of the raffle when there is a just cause or reasons of force majeure that prevent it from being carried out in the form in which these rules are set out .

NOMADFESTIVAL MEDITERRANI SLU and XALET DE PRADES SL reserve the right to postpone or extend the draw period. The organizing companies reserve the right to shorten, extend, modify or cancel this raffle, if exceptional circumstances occur that prevent it from being carried out, communicating these circumstances in such a way as to avoid any harm to the participants in the raffle.

The organizing companies reserve the right to remove from the draw for justified reasons any user who defrauds, alters or disables the proper functioning and normal and regulatory course of the same.

​

8. PUBLICATION OF COMMENTS OR OPINIONS
Comments, images or opinions whose content is considered inappropriate, which are offensive, insulting or discriminatory or which may violate the rights of third parties, will not be allowed. Images that do not comply with this precept will be disqualified from the competition. Nor will comments against an individual be allowed that violate the principles of the right to honor, personal and family privacy and one's image. We are not responsible for the damages caused by the comments made by the participants in the Draw and which at any time may hurt the sensibilities of other participants or people.

9. DISCLAIMER OF LIABILITY
By way of example, but not limitation, we are not responsible for possible losses, thefts, delays or any other circumstances attributable to third parties that may affect the development of this draw, nor are we responsible for the participant's use of the prize you get, nor any extra expenses or incidents that may occur.
We do not assume responsibility in cases of force majeure or fortuitous event that may prevent the completion of the Draw or the full or partial enjoyment of the prize.

10. FACEBOOK

The promotion is not sponsored, endorsed, administered or associated in any way with Facebook, so participants release Facebook from all responsibility for damages that may arise from it.

11. PROTECTION OF PERSONAL DATA

The data provided by the participants will be treated confidentially and collected in the automated processing records of personal data, being NOMADFESTIVAL MEDITERRANI SLU, with registered office at Ronda Maiols 1 local 110-112 CP. 08192, Sant Quirze de Vallès, Barcelona and XALET DE PRADES SL, with registered office at C / Riu Brugent 16, CP.43364 Prades (Tarragona), holders and responsible for these records, the purpose will be the management of this draw and the making commercial communications to interested parties. The legitimate interest in participating in the contest expressed in the acceptance of these conditions is identified as a legitimate basis.

12. ACCEPTANCE OF THE BASIS

Simple participation implies the acceptance of these Terms, so that the expression of non-acceptance of all or part of them will imply the exclusion of the participant and, as a consequence of this, NOMADFESTIVAL MEDITERRANI SLO and XALET DE PRADES SL are released from fulfilling the obligation contracted with this participant.

13.- APPLICABLE LEGISLATION AND JURISDICTION

These legal bases will be governed in accordance with Spanish law. They will be competent to resolve any claim or controversy that may arise in relation to its validity, interpretation or compliance in the courts and tribunals of the city of Barcelona, expressly waiving any other jurisdiction that may correspond to them.
